We have an adult relative that has been served with a document “NOTICE TO APPEAR Police Powers and Responsibilities Act 2009 Section 382” on 22/02/2021,COURT OF SUMMARY JURISDICTION BRISBANE MAGISTRATES COURT(Roma Street)
for:
[PPRA] 790(1)(B)& 108B OBSTRUCT POLICE OFFICER 108B COA PUBLIC PLACE ADVERSELY AFFECTED
and
DID DRIVE U.I.L. (MOTOR VEHICLE TRAM/TRAIN/ VESSEL) [TORA] 79(1)(A)
At the time of these alleged offences our relative was on prescription medication, and could have been having a psychotic episode, not caused by the medication. The relative, after the event and is now continuing to receive treatment for a mental health condition.
Primarily we would want an early case conference and the charges withdrawn
Does you legal firm have previous experience in such matters, in particular DUI and obstruct, involving prescription medication and the accused with a mental health condition?
If not, do you feel you have the expertise to handle such a case and if so why?
Otherwise, could you recommend a legal firm that does have that experience and or expertise?
What fees do you charge for your services and what is your agreement for providing legal services?
Would your firm consider reduced fees for a person that has no income for the last 2 years? (eligible but not currently receiving Centrelink benefits, not eligible for Legal aid because of some savings).
