I ask because in your email you referred to our claim for “Reels” (404815473705) however my claim was about the 🔥Fold 1000W Motor Electric Bike eBike Mountain Bicycle🔥48V E-Bike Commuter Au (305609415344). The “reels” is a different item and not ours.

Also your email subject says “Re: HEre's how we did SR# 1-486936534618”. This is not the current email string subject but it does refer to my purchase number. The current email string eBay and I have been using says “Re: Re: Be assured that you are covered with eBay Money Back Guarantee. SR# 1-486936534618 THIS IS URGENT”

Is this just a typo or has Ebay confused me with another buyer?

Can you please confirm that the refund you refer to in your email below is for the ebike, $1,086.45 to Geoff Greig?

Jayson, please note that the bike was picked up at 4pm today from my home so I have now returned the bike. Tracking no. is 3434172708874, the shipping company name is Direct Freight. I also spoke to Ebay by phone (Kristin) and gave her these details.

Kristin has explained the refund details to me, and took the tracking details over the phone as I couldn't find anywhere on My Ebay to input it.

I would like to update you on events since you kindly reassured me on Monday morning (28th October) (below) of my refund. At that time, you wrote that you checked to verify the label the seller sent to me at 2am and you had decided that label is “insufficient”. (Shipping label no. was F3X654211401000650806). (The second Invalid label sent to me).

For your further information I also spoke to Parcel Post who confirmed with me that that shipping label the seller sent to me was actually only booked for a 2kg parcel. (Conversation Reference Ref# 63950376) . Parcel Post are happy to confirm with you also (Gertrude).

As you can see I have been able to now return the bike but only after my asking the seller twice what day was pick up, then receiving from them yet another, different, label again, later in the day for a return to the previous return address (same return address as the first invalid label).

I am telling you this to further demonstrate the seller's bad ethics, dishonesty and deliberate attempt to avoid the refund to me for the last month. And I am most concerned about how other buyers will be affected by the seller's unscrupulous behaviour, some of whom I am sure have given up or been tricked into giving away their buyer rights, then with no recourse to EBay, and having to keep a deliberately substandard or lesser product. I believe this was never a mistake, but business as usual for this seller.

If the seller had acted honestly and in good faith I would have had my refund paid in early October. And also the seller has broken several EBay rules, and even admitted to me he knew it was wrong (via private email which I was forced to use as I got very little from their Ebay email address.)

Anyway, the bike is now picked up and returned and I have spoken by phone with Ebay (Kristine) and she has explained everything and that Ebay will be making the refund.

Thank you Ebay for supporting me. I hope there are repercussions for this seller.

I refer to you reassurance to me yesterday that the seller must send a valid shipping label by 31st October or Ebay will refund me.

At 2am today the seller first sent the same invalid shipping label as the previous two times. Maybe a mistake.

Two minutes later a new label was sent.

The new label says NO SIGNATURE REQUIRED. (I believe Ebay requires the shipping label to be Signature Required for items over $750? The cost of the ebike was $1,086.)

Parcel Post on their website says maximum weight to be 22kg. The ebike is over this weight. Their online calculator does not accept the dimensions when I inputted them, because the item is too large.

The carrier is now Parcel Post.

I believe Parcel Post is unaware of the contents, weight and dimensions of the package that has been booked.

I believe this new label is an invalid shipping label for the return of the ebike.

(Incidentally, the return address is, again, a different address to the last 2 return addresses nominated previously. Whilst allowed, seems suspicious)

We do not know when (day or time) the parcel will be picked up and so I am writing to you urgently in case Parcel Post arrive when I am not home. I cannot ring them until office hours open this morning.

What happens if Parcel Post arrives and refuses to pick up the bike? What happens if they pick up the bike with the No Signature stamp? I need to know what to do, please help me.

This seller is still sending me in circles and keeps finding new ways to avoid pick up and refund.

Thank you for your email this morning.

The seller has now replied today saying we must return the bike in original packaging. I have explained to the seller today and also previously, and to Ebay today, that the original packaging was damaged on arrival, structurally unsound and unusable. I have also explained to the seller that the bike is currently packed securely and protected. (I have photos of the bike currently wrapped and packed).

This is not a change of mind return, the seller sent a different ebike, lower specification and also an unusable battery charger (in a small box that was also damaged). The lower specification bike had to be removed from the packaging to check voltage indicator and battery, once the bike was assembled. Due to the damaged box on arrival the box was literally falling apart as I removed the bike for inspection. (I have photos of the original packaging).

From the seller's message, I don't think they will send that valid shipping label if we are not using original packaging.

Yet another seller attempt to avoid return and refund.

Please let me know if you wish to see my photos of the original packaging and current packaging.

Does the 5 days (from yesterday) for seller to send the valid shipping label still stand?

I am providing an update to the email I sent you yesterday which is below, telling you the seller has not sent a valid shipping label.

I also had an Ebay chat session yesterday with Ebay, Abhishek. I was told the seller has now been given 5 days by Ebay to arrange a valid label and the seller was notified by Ebay of this. See extract from my chat session.

03:28:03 UTC Abhishek I have checked the details and here I can confirm that the label expired and you have asked to send them another label for Oct 28, 2024. Hence, I have placed this case on hold so that the seller can arrange that for you. I have notified them regarding this as well.

I am now providing another update. Following eBay's notification to the seller earlier yesterday, later yesterday the seller sent another invalid shipping label. The exact same one they sent previously, dated 17th October which Ebay says is expired and the freight company told me it had been cancelled and cannot be used.

I have again told the seller this.

The seller says in 2 emails yesterday that we can continue to use that label (but which both Ebay and myself know is expired, cancelled and invalid).

The seller also said we need to use original packaging, however, I had notified the seller via Ebay previously (I have photos) that the original packaging was so damaged and structurally unsound on arrival it literally fell apart when unpacking.

The bike and components are currently wrapped, packed and protected in a sturdy bike box and ready for pick up on 28th October.

The seller is clearly deliberately delaying the return and refund process.

Ebay has assured me that :

(the shipping company told me that it had been cancelled)..

To give the seller as much notice as possible to ensure the bike was picked up, I was able to advise them one day earlier than the agreed 25th October, to make the pick up Monday 28th (as their shipping company do not pick up on weekends) and I ASKED THE SELLER FOR A NEW VALID SHIPPING LABEL.

TODAY, SATURDAY 26th I HAVE NOT RECEIVED THAT LABEL.

Please update the status of my purchase in My Ebay, as it will close the case on 31st October if I don't send tracking details. This information on My Ebay is based on a CANCELLED shipping label/ consignment note (so I don't have tracking details) and My Ebay also has the return address the seller has been using via Ebay but is NOT the address on the CANCELLED shipping label/consignment not. (The seller gave me a Rydalmere, NSW address for return via Ebay communications (which is the address on My Ebay) but the cancelled shipping label gave an address in Moorabbin, Victoria).. Please check that shipping label as Ebay sent me a copy as the cancelled label appeared fuzzy on my screen). I have not trusted this seller for some time, I now fear the seller is scamming the system by using different return addresses and not issuing a new, valid shipping label.

I have the bike ready for pick up. The seller replied to my request for a new shipping label on Thursday 24th October, but has still has not sent it.

SUMMARY

I CANNOT RETURN THE BIKE BECAUSE THE SELLER HAS NOT SENT A VALID SHIPPING LABEL.

WHAT I WANT TO HAPPEN

Please assure me again, as you (Ebay) did in an email on 24th October at 10.38am that I am entitled to a full refund.

Please confirm that the case won't be closed on 31st October as the responsibility us currently with the seller.

PROOF Attached is a screen shot from Direct Freight showing that that shipping label/consignment note is not active. You already have a copy of that invalid shipping label/ consignment note to verify the actual number is the same as in the screenshot.

The seller involve has repeatedly made attempts to circumvent eBay's policies and has admitted that to me.. Hence I am fearfully that he will try a similar thing if I were to return the bike and I could end up without the bike and what I paid for it.

What if the seller wrongly and maliciously says the bike, on return, is damaged what happens then?

The reason for the return was the bike was SUBSTANTIALLY not as described.

My question to eBay, as to how long the seller has to respond to my request for a partial refund, before eBay steps in with their Money Back Guarantee, is still not answered

Can you please tell me how long that time is?

In your email below you state we have 7 days or to 19 October to return the bike. I remind eBay that eBay said in an email to us on 18th October at 4:38pm, that we had until the 27th October to return the bike and that the seller agreed to wait until 25th for us to tell them a pick up date as we are not home until 25th.. The seller has now sent numerous emails today asking for a pick up time and it is not yet 25th and we are not home to pack the bike.. Please see here below an extract from eBay's email stating 27th October for pick up.

“…..Upon review on the case, we see that your seller has messaged you on October 16 sharing details of label for pick-up. They also mentioned that they will arrange the courier to collect the item from your home after October 25 instead of sedning funds for shipping. Since you received unreadable label on your end, we have forwarded the label to you and kindly check the attachment. As of now case is currently on forced return status until 27th of October. To proceed, we encourage you to continue communicate with seller regarding the scheduled pick-up date as they already agreed to contact you after 25th once your back home…”

So we have until 27th to return the bike and will notify the seller of pick the up time, as agreed by the eseller via eBay email.

On 2nd October the seller offered me a discount/partial refund as compensation for sending me the wrong e-bike with a lower specification. At the time I did not accept that offer as I just wanted the e-bike with the specifications that I paid for. This was before I requested a return/refund.

Because the seller has delayed the refund request for over a month (even though he accepted he would refund the full amount), I suggested on Saturday 29th October that we agree on a discount/partial refund (as offered by the seller previously). This would resolve the issue now and the seller would not need to pick up the bike, saving him money. I sent this request, for attention to the boss, via Ebay email to the seller. Again, the customer service person said I must communicate directly with their boss, I replied that they should pass on this request to their boss..

The boss “Darren” then replied to me via his private email. He agreed to make the partial refund BUT only if I Close the Dispute FIRST. Then he said the Ebay system does not let him make the partial refund until the dispute is closed.

He said, quote, “you was open dispute by ebay, so I don't have refund button, are you understand”.

Because of this I sent him my bank account details (which he had asked for the first time he offered a partial refund) and I have heard nothing.

My understanding is that eBay allows an agreement to be reached to resolve the dispute and payment can be made.. The seller says otherwise.

This is again the seller not acting in good faith and the second time he has tried to take my buyer rights away.. (See my previous emails to eBay)..

I am still waiting for the seller to respond to my last email.

I can not find anywhere on eBay's website where it says how long the seller has to respond to my request for a partial refund before eBay steps in with their Money Back Guarantee.
